| |  | Jeremy Samek's practice focuses on commercial litigation and general civil litigation matters. His experience consists of matters involving complex contractual issues, vehicle and motorcycle manufacturer defense, federal class action defense and class action settlement, employee wage and employee classification issues, employment non-compete agreements, OSHA compliance and litigation, preparation and execution of mechanics’ liens, products liability defense and insurance coverage defense. Jeremy has represented clients in state and federal courts and in both arbitrations, mediations and jury trials. Jeremy is also an arbitrator in Allegheny County and has been called upon to hear and determine disputes as part of three person arbitrator panels. Prior to joining Eckert Seamans, Jeremy was a Staff Sergeant in the United States Air Force Reserve, working in the Air Transportation Logistics field. In 2005, he was deployed to Kuwait in support of Operation Iraqi Freedom and in 2006, he was deployed to Kyrgyzstan in support of Operation Enduring Freedom. Jeremy serves as a member of Eckert Seamans’ Associates Committee.
- Represented employers against the Department of Labor in proceedings and in trial arising out of claims of OSHA violations;
- Represented an importer in successful litigation in the United States Court of International Trade in an action against the Federal Government related to classification of an imported product (Int'l Custom Prods. v. United States, 2012 Ct. Intl. Trade Lexis 141 (Ct. Int'l Trade Nov. 20, 2012);
- Represented water, fire, mold restoration company client on a variety of contractual and employment related matters;
- Represented steel and other metal manufacturing clients in federal court, state court, and arbitrations related to steel industry operations, contractual disputes, personal injury actions and demurrage shipping claims;
- Represented automobile and motorcycle manufacturers in state court;
- Represented national insurance company in bad faith insurance coverage dispute;
- Represented pharmaceutical client in connection with product liability lawsuits;
- Represented company in a national class action lawsuit involving the classification of certain employees as independent contractors and Wage Payment Collection Law, Minimum Wage and Fair Labor Standards Act claims;
- Represented contractor in successful resolution of a claim for payment for services the contractor rendered to a major hotel chain;
- Represented various commercial property owners in litigation and arbitration, and obtained numerous judgments in the property owners’ favor;
- Represented equipment owner in a successful jury trial in a claim for conversion of the owner’s property;
- Represented shipping and trucking companies in various litigation.
